Aldec Inc. Seeks Preliminary Injunction Against Xilinx
HENDERSON, Nev.--(BUSINESS WIRE)--April 9, 2002--Aldec Inc., a
pioneer in mixed language simulation and advanced design tools for
FPGA and ASIC devices, today announced that it is seeking a
preliminary injunction in San Francisco's Federal Court against
Xilinx® Inc. (Nasdaq:XLNX - news) of San Jose, Calif.
Aldec and Xilinx signed an OEM Agreement on Jan. 5, 1996, which
authorized Xilinx to distribute Aldec's patented and copyrighted
software as part of its Foundation Series(TM) software, used for
designing Xilinx field programmable gate array (FPGA) devices.
It is believed that over 20,000 customers are using the Aldec software worldwide and their designs created one of the major markets for Xilinx devices.
Despite the fact that the OEM Agreement expired on Jan. 5, 2002,
Xilinx continues to distribute Aldec products, acting in violation of
Aldec's intellectual property of those products. All attempts to
resolve this issue and cease unlawful shipments of Aldec intellectual
property were unsuccessful.
"It is a simple case of large guy bullying a small one and
thinking that he can get away with it. Our only hope now is in the
federal courts," stated Stanley Hyduke, president of Aldec.
